The former Manchester City defender Benjamin Mendy has been successful in his employment claim against the club while he was facing rape charges

In a judgement, published today, Employment Tribunal judge Joanne Dunlop’s concluded that Manchester City were not entitled to withhold Mendy’s pay while he was not in custody

The player had claimed £11m but the ruling means that for the 17 months that they withheld wages but was not in custody, the club should pay  but Manchester City do not have to pay him for the five months he was in custody.

City’s lawyers said Mendy was not paid because he “was not ready and able to perform his duties … as a consequence of his own conduct”, as he was held in custody before his trial for breaching his bail conditions.

In a statement Mendy said that having  had to wait three years for his wages he hoped the club would do the honourable thing and pay the amounts owing
