A fly tipper, who dumped rubbish in an alleyway as well as using residents’ waste container bins to dump building materials and household waste has been given a comunity order,a fine and banned from driving

Daniel Chiwoko, aged 49, of Longford Street, Gorton, had pleaded guilty to the fly-tipping offence under the Environmental Protection Act 1990 Section 33(5) at a hearing in June last year and was sentenced at Manchester Magistrates Court yesterday.

He received a 12-month community order with 100 hours of unpaid work and was disqualified from driving for 3 months. He was also ordered to pay costs of £522 and a victim surcharge of £95, making a total of £617.

He had driven his white Ford Transit vehicle to Beresford Street in Moss Side on 21 December 2021, reversed down the street to park in front of the residential waste containers, filled the containers with building materials and household waste until they were full, leaving no room for local residents to get rid of their waste. He went on to dump items that were too big to fit into the containers into the adjacent alleyway.

A local resident who witnessed this happening, sent photographic evidence to the Environmental Crimes Team, who subsequently traced the vehicle owner Mr Chiwoko.

He was invited to a recorded interview, which he attended on 21 April 2022 and admitted the offence when shown the witness’s photographs. He claimed that he thought he could put the waste in the residential containers as he was disposing of a friend’s waste who lived close by, however he did not provide any details of this person.
